2013-06-10 「特許明細書」という物語

昨日、特許のお話をしたので、その続きということで。

特許権に関する幻想を持っている人って多いと思うのですが、我々研究員からすれば、発明は単なる業務です(なお、上記の内容は古い上に、若干の嘘もあります。特許法は殆ど隔年で改正されていますから)

もっと直接的に言えば「ノルマ」。

「発明」がノルマでできるのか、と思われるかもしれませんが、特許発明というのは、一種の小説とかコミックマンガと同じような「創作物」でもあるのです。

「発明」を記載する明細書には、物語、すなわち「ストーリー」が記載されなければなりません。

それを読む特許庁の審査官を、「感動」させなければならないからです。

特許明細書の内容は、概ね、こんな感じになっています。

(Step.1)まず、巨大な悪の帝国を記載します(課題)。この巨大な悪の帝国を滅ぼす為の兵器を登場させます(課題を解決する公知の技術)。

(Step.2)ところが、この兵器が全く悪の帝国の帝国軍に太刀打ちできず、自由同盟軍は敗走します(公知技術でも解決できない課題)。

(Step.3)そこに、自由同盟軍の新型兵器が登場します(本願発明)。この新型兵器は、誰も見たことがなく(特許法29条1項)、そして誰も思いつくことができな かった(同2項)ものです

(Step.4)自由同盟軍の新型兵器が、帝国軍のくりだす全ての兵器を撃破し、自由同盟軍は最終的に勝利を収めます(本願発明の効果)。

こうして、皆が幸せになることで、物語・・・もとい、明細書は終了します。

前回の特許明細書で、私は8割を書き上げたところで、「あれ?」と気がつきました。

―― この新型兵器では、悪の帝国の反撃で、撃破されてしまうじゃないか?

こうなると、最初からストーリーを組み直すことになります。

仕事の大半がパーになって、かなり泣けます。

とはいえ、もっと優れた新型兵器をホイホイ発明するのは難しいです。

ですから、ストーリーの再構築に際しては、姑息な手段を考えることになります。

例えば、―― 悪の帝国を最初から「弱く」設定しておく、とか。

特許明細書という楽しくもない文章を、特許庁の審査官に読んで貰うには、それ相応の技も必要なのです。


2014-06-10 パパの親切とは、『無償かつ無限の親切』ではなく『無償だが限定的な親切』だ

先日、満員電車の中でのことです。

The other day,

座席に座って、吐きそうな様子をしている若い女性の前に立っていた私は、次の駅で、即座に下車して、別の車両に乗り換えました。

特許ブレストにつきあわされた後での、昨日の日記を読んだ後輩との会話です。

After the patent brain storming, I chatted about the yesterday's diary of mine with my junior fellow.

後輩:「そりゃ、手紙でも何でも書きますよ。でも、バカバカしいですよ」

Junior:"If you want, I write a letter or anything to your daughter. But it will be radish."

江端:「何で?」

Ebata:"Why?"

後輩:「私達は『浮気』という行為から、もっとも遠いところに位置している人間ですよ」

Junior:"We are absolutely far from "affair" in the world."

江端:「言わんとしていることは分かるが」

Ebata:"I understand what you want to explain."

後輩:「私達が浮気できるなら、世の中からは女性はいなくなりますよ」

Junior:"If we can cheat, all of woman in the world become to lose."

江端:「・・・?」

Ebata:"...?"

私がよく分からないという風に、首をかしげると、彼は話を続けました。

When I looked quizzical, he continued his talk.

後輩:「私達が1人と浮気できるなら、普通の男性なら20人と浮気が可能です。『浮気市場』における完全な供給不足に陥いります」

Junior:"If we can cheat one woman, other men except us can cheat more than twenty women at the same time. In the "love affair" market, women will come short."

江端:「ま、そうだよなあ。浮気って、やっぱり一種の才能だと思う。あれは資質のある人間にしかできないと思う」

Ebata:"I agree. and I also think "affair" needs some kinds of talent and qualifications."

後輩:「もし、私が何日も自宅に帰宅しなくても、私の嫁は『事故かもしれない』とか『仕事に夢中になっているかもしれない』とは思っても、『浮気をしているかもしれない』とは絶対に思わないですよ」

Junior:"Even if I don't go back home for several days, my wife will think the possibility of accidents or works in the office. But I can tell the world "she never think of my affair."

江端:「多分、ウチもそうだ」

Ebata:"My wife, too."

後輩:「独身の時、合コンの最中に『かったるいなぁ、早く帰って、あの論文読みたいな』と思ってしまう人間ですよ、私は」

Junior:"I am a person who can think "I want to go home and read the paper soon" in during the mixer party."

そういえば、私も、デートの最中に、『彼女を駅に送ってから、何時ごろに研究室に戻れるかなあ』ということを思ってしまう人間でした。

Come to think of it, I also thought "What time can I arrive at the lab, after this date."

ここで一息ついて、後輩は言いました。

江端:「まあ、そうだけど・・・そこまで、はっきり言われると、腹立つな」

Ebata:"You are right, but I am also totally disgusted with you."


2016-06-10 「人間、楽しく感じることができないことを覚えることは難しい」

私が今一つ、年齢に応じた昇進ができないのは、このような、「徹底した他人事意識」にあることは。

マジョリティに共通する話題を持つことは、コミュニケーションにおいて、必須事項であることも、分っています。

I also know that it is important to have common popular topics for majority of people, in order to keep good relationships in the world.

だから、私も努力はしたんです。

So I had made efforts for them before.

野球やサッカーのチームやプレーヤーの名前を暗記しようとしたりしました。

I had tried to learn the names of football, baseball teams and the player by heart,

結局、この努力は無駄でした。

However, it had been in vain.

私には、娘の勉強につきあって、チンギスハンの息子や孫が、ヨーロッパや東南アジアに侵攻を始める年号を覚える方が、遥かにラクだったのです。

For me, it is easier to learn the year that Chengjisi Han's son or grandchild started to make inroads into Europe or East-Asia than above with my daughter's homework.

「人間、楽しく感じることができないことを覚えることは難しい」 ―― を再確認しただけでした。

After all, I could re-confirm that "For human beings, it is difficult to learn anything that we feel difficult.

2017-06-10 ―― そのチームの監督には、酷く同情します。

現在、日本でもっともメジャーなプロ野球チームが、結構な連敗を続けているそうです。

2018-06-10 教師とは、『その言い訳を生徒に許さない存在』として、存在しているのですから。

(昨日の続きです)

この問題の大部分は、教師側に帰着してしまうのですが、それでも私は、『教師にそんなITリテラシーはない』『教師は忙しくてそんな勉強時間はない』という言い訳を許すつもりはありません。

Most of this problem comes to the teacher side, however I do not allow the excuse that "there is no such IT literacy for the teacher", "the teacher is busy and there is no such study time".

教師とは、『その言い訳を生徒に許さない存在』として、存在しているのですから。

Because a teacher exists as "a existence that does not allow that excuse for students".

しかし、どんなに教師を叱責鼓舞したところで、実際のところITリテラシーの向上は難しいとは思います。

2019-06-10 ―― 私を2週間もの間、苦しめ続けたことは、許せん

私は、19歳の時にパソコンに手を出してから、パソコンに関しては、相当数の地雷を踏んできました。

When I was 19 years old, I started working on my computer, and then I hit a lot of landmines on my computer.

HDDのクラッシュや、ハードウェアの故障で、何度、データをオシャカにしてきたか知れません。

I don't remember how many times that data has become an obscene due to HDD crashes or hardware failures.

ですので、これらの問題に対しては、かなり周到に色々な準備をしてきました。

So, for these problems, I have prepared quite a lot of preparations.

カーネル単位のバックアップとか、BIOSの設定(USBブートとか、ネットワークブートとか)は、万全にしてありますし、F1,F12, CTRL-I等の、様々な起動時割り込みも試みてきました。

そんな私が、ここ2週間ばかり、パソコンの起動に失敗して、疲れ果てていました。

―― 原因が全くわからん

昨日は、ついに、PCの中身を開けて、ホコリを取り除き、ボードの電池(CR2032)を交換しました。

Yesterday, at last, I opened the contents of my PC, removed the dust, and replaced the battery (CR2032) on the board.

それでも時々、起動に成功したりするので、「ボードがお亡くなりになった」と断定もできず、頭を抱えていました。

Even so, sometimes I was able to launch successfully. I could not say "the board has passed away" with his head in his hands.

とりあえず、これでは仕事にならないので、メインのPCを別の代替マシンに切り換えて、作業していました。

そして、一つづつ、原因を潰していったら、最終的に、充電用にUSBのハブに差し込んでおいた、

"HUAWAIのスマホ"

"HUAWEI's smartphone"

が原因であることを、特定しました。

as the cause.

"HUAWAIのスマホ"のUSBは、単に電源供給モードとして使っていただけであり、実際、ブートの対象にはなるはずない ―― と思い込んでいました。

I thought that the USB of "the smartphone of HUAWAI" was only used as a power supply mode, and it should not be the target of boot.

しかし、"HUAWAIのスマホ"を接続した状態では、2台のパソコンで同じ現象が現われ、外したら、問題が解消されたことから、この問題の原因であることが確定しました。

However, with the "HUAWAI smartphone" connected, the same phenomenon appeared on two PCs. and with disconnected, the same phenomenon disappeared.

現在、我が家には、"HUAWAIのスマホ"しかなく(次女だけがiPhoneに固執している)、他のAndoroid機器での実験はできていませんが、少なくともiPhoneでは問題は発生しませんでした。

2020-06-10 ―― 自分の書いたコラムでヒットしました。

ですので、今回のコロナ災禍を契機としたテレワークによる働き方の変化は、これから10~20年で現われてくるのかもしれません。

とすれば、「朝のラッシュ」については、「今」ではなく「10年後」に評価しなければいけないのかもしれません。

2021-06-10 ―― 猛吹雪の中、雪をかき散らしながら、爆走する一台のカブ

アニメ「スーパーカブ 第10」話で、主人公が雪の中をノーマルタイヤでカブを走らせるシーンが登場します。

In the anime "Super Cub #10" episode, there is a scene where the main character drives the Cub through the snow with normal tires.

雪道の運転は、自動車でも危険です。しかし、バイクの場合、「転倒確定」の危険です。

私の場合、従量9kgのラップトップコンピュータ「PC-9801LS」(定価88万6千円)を、ずた袋にいれて、毎日携行していたので(本当です)、バイクなしでの移動というのは、現実的に不可能だったのです。

『余計なことを考えずに済む、充実した激務の日々』 ―― この一言に尽きます。

"The days are full of hard work, and I don't have to think about anything else". That's all I could say.

私の「ボッチ」気質と、「技術大好き」気質が、驚くほど上手く噛み合った幸運だ、と思っています。

I consider myself lucky that my "alone" nature and my "technology-loving" nature mesh surprisingly well together.

それはさておき。

高校3年生の時、私、北海道大学の受験のついでに、3月の北海道を2週間近く、電車で放浪していました。

When I was a senior in high school, after taking the entrance exam for Hokkaido University, I wandered around Hokkaido by train for almost two weeks in March.

食パンを一斤購入して水で流し込む日々を繰返しながら、周遊券を使って、北海道の各地(というかほぼ全域)を回っていました。

I spent my days repeatedly buying a loaf of bread and pouring it down with water, while using a round trip ticket to visit various parts of Hokkaido (or rather, almost all parts of Hokkaido).

(なんか、この食事自体が、アニメ「スーパーカブ」の主人公と似ています)

(Somehow, this meal itself is similar to the main character in the anime "Super Cub".)

その旅の最中、電車の車窓から

During the journey, I saw

―― 猛吹雪の中、雪をかき散らしながら、爆走する一台のカブ

"a running motorcycle with blowing away snow in a blizzard"

を見ました。

from the train window.

そのライダーのテクニックは、本当に凄かった。

The technique of the rider of that bike was truly amazing.

■雪によって流されていくカブの動きを予測しながら、

- While anticipating the movement of the bike as it is swept away by the snow,

■スピードを落すことなく、

- Without slowing down,

■車体を左右にドラフトさせて、

- Drafting the bike from side to side,

■深雪の道路をラクラクと運転する

- Driving easily on roads with deep snow

■農作業姿のおじいさん

- An old man in farming clothes

実際に、電車と併走していたんだから、凄いスピードです。

In fact, he was running alongside the train, which was a great speed.

―― なんて、かっこいいんだ・・・

"Oh, my God, he is so cool"

私は、窓にしがみついて、カブを運転するおじいさんを、見続けていました。

I clung to the window and kept watching the old man driving the Cub.

今でも、私はあの光景を思い出す度に、『カッコイイとは、こういうことさ』という、ポルコ・ロッソ(アニメ『紅の豚』)の台詞が思い浮びます。

Whenever I remember that scene, I still think of the line from Porco Rosso (the anime "The Red Pig"), "That's what cool is".


2022-06-10 ヒットした記事が、自分のブログだったときの絶望感は、かなりデカいです。
