ネットでの論争を見ていると、『「立証責任」の考え方を知らない人が多い』と思います。
Watching a dispute on the Internet, I think that many people don't know "burden of proof".

ある未来における二択の事象、例えば、英国の「EU離脱 or EU残留」の議論があったば場合、
If there are future two choices, for example "EU separation" or "EU stay" in UK,
トム：「EUから離脱すべきである。利益があるからである」
Tom:"The UK should be breakaway from EU. Because the choice brings us a profit."
ナンシー：「EUに残留すべきである。利益があるからである」
Nancy:"The UK should stay in EU. Because the choice brings us a profit."
という議論で、論争は始まる訳ですが、
A dispute is going to start like the above arguments.
議論が白熱してくると、
While becoming incandescent,
トム：「そんなことはない。EU離脱の方が利益がある」
Tom:"You are wrong. The breakaway is better than stay."
ナンシー：「では、『EU離脱が利益がある』という根拠を示せ」
Nancy:"If you say so, show me the evidence of your opinion"
とまあ、結構な頻度でこういう展開になります。
In many case, this type of argument is going like the above.

しかし、この場合、ナンシーの言動は、正当性を欠いているのです。
However, in this case, Nancy's opinion is not fair.
これは、

"Nancy has a responsibility for "burden of proof" of "The breakaway is worse than stay."

がある、ということです。

This is a simple story.
ナンシーがトムを論破する為に汗を流すのは、「ナンシー」であるべきで、
It is Nancy who should make an effort to argue TOM down, and
ナンシーの為に「トムが努力する必要はない」ということです。
Tom doesn't have to make an effort for Nancy's argument.
これを、
According to a legal parlance,
「立証責任は、その利益を得る側に発生する」
"Burden of proof" is generated by the side that needs the profit.
と言います。
