2013-06-18 「児ポ法改正」に関する一考察(最終回)

「児ポ法改正」の考察、最終回です。

正直なところ、私は「単純所持」は、「心配」ではありますが「激怒」はしません。

私が心底腹を立てているのは、今回のこのフレーズです。

『自己の性的好奇心を満たす目的で所持』

なんだ、そりゃ?

個人の内心に関するものが「法定」された上、裁判所で、その認否が検証される社会になるのか?

私は、そんな気色の悪い法律を制定する国家に属して、生きていかなければならないのか?

個人の主観的意思に基づいて法定されているものがあることは、昨日ご紹介した通りです。

しかし、「自己の性的好奇心を満たす目的で所持」って、その客観性をどのように担保するのか。

■取り調べで、オナニーの回数を被疑者に自己申告させるのか?

■被告に少女の全裸の写真を見せて、裁判所で男性器の勃起の強度でも検証するのか?

この法律は、刑法ですから「罪刑法定主義」が適用されなければなりません。

証拠に関して裁判官の「自由心証主義(=物的証拠はないが、状況から見て認定できる)」は制限され、絶対的な物証が要求されるのです

と考えると、上記の例は、「フィクション」の話ではないのです。

「自己の性的好奇心を満たす目的」というこの一文は、それ自体が、文明国にあるまじき「下品さ」である、と思えるのです。

こんな下品な法律を制定されるくらいなら、単純に「所持」だけの方がはるかにいい。

では、こうしよう。

私は娘たちに頼んで、そのような写真を撮影させて貰い、普段から持ち歩くことにする。

そして、私は、それを「自己の性的好奇心を満たす目的で所持している」と宣言する。

裁判官に「『自己の性的好奇心を満たす』とは、どのようなことですか」と問われたら、「そのような定義がないのでさっぱり分からんが、とにかく『満たしている』ということにした」と答える。

「『罪刑法定主義』に基づいて、きちんと私を裁いて下さいね」と、裁判長にお願いすることにする。

法律が個人の内心に関与することを許すのであれば、面倒くさいので、この際、ついでに、

「利潤の追求が推認されるNPO」とか

「名誉を追求する目的のボランティア」とか

「老後を心配する為に育児をする保護者」とかも

もう面倒だから、全部、違法行為の対象としてはどうだろう。

このような考え方は、暴論だろうか?

いずれにしても、「性的好奇心」という個人の内心のコアを明文化する、この厚顔甚しい法律が制定されたら、

この法律を起草した奴の名前と、それに賛成を投じた議員の名前を、私は一生覚え続けて、ことあるごに、それを引き合いにして、誹謗中傷を繰り返してやる、と

―― 今、決めた。

今、「研究ノート」なるものの話題がホットのようです。

I write by my original format (based on MindMap), it is difficult for many people to read and understand my thoughts. To begin with, I am afraid that nobody can understand my texts.

あれは「きれい/汚い」という次元ではなく、可読が「可能/不可能」の文字ですし、論理的に記載していないし ―― そもそも「研究ノート」を書いているという気持ちがない。

という二つの観点から、私達、コンテンツ消費者ふぜいが、それを批判・非難することは、理不尽なのです。

it is an unreasonable action for us, just content consumers, to blame the creator's challenge toward a new contents styles.

むしろ、そのようなクリエータを、些細な力であっても支えて上げることのできる、「コンテンツ消費者」であるべきだ、と、私は思うのです。

If anything, I think that we must be good supporters for the creators, even if the support is trivial matter.

この時に見た、このコンテンツのキャッチフレーズが、なんとも、私には新鮮に感じられました。

2019-06-18 「キングダム」でも「宇宙兄弟」でも「最初の一歩」でも、「トトロ」でも「風立ちぬ」でもなんでも構いませんが ――

最近、「マンガに学ぶリーダー論」とか、「アニメの主人公の語る人生訓」とか、その手の記事が多いです。

Recently, there are many articles such as "Leaders of manga", "Life lessons told by the main character of animation", and so on.

これらの記事は、読んでいて楽しいし、面白いです。

These articles are fun and enjoyable.

しかし、同時に『多分、読み手の役には立っていないだろうなぁ』とも思っています。

However, at the same time, I also think that "these articles are not useful for the readers".

その根拠の一つに、『その記事を読んでから、1時間後には、その記事のことをすっかり忘れてしまうから』です。

One of the basis is "we can erase the content of articles within one hour after reading it"

次の日に、その記事のことを思い出す人はほとんどおらず、私たちは、なんの教訓も得られない日常を送ることになります。

Few people can remember the article the next day. As a result, We will be sending our daily lives without any lessons.

これは、「自分を変える」「自分を好きになる」ではじまる題目の書籍についても当てはまります。

私は、これらのコンテンツの内容が無意味である、とは思っていません。

■そのアクションのプロセスの中で発生する各種のトラブルを体験して、

- experience various troubles that occur in the process of the action

ようやく、その教訓が「定着」する、と思っています。

2020-06-18 Let me see... It's "Scent of a woman" (セント・オブ・ウーマン(邦名「夢の香り」)

以前、どっかで書いたような気がしますが、どうしても見つけられなかったので、ネタかぶりを覚悟して、もう一度記載します。

I think I've written about this somewhere before, but I couldn't find it in my homepage, so I'm going to state this again, at the risk of spoiling the story.

私、2000年から2年間、コロラド州のフォートコリンズという街に、エンジニアとして赴任していました。

I was assigned to Fort Collins, Colorado, as an engineer for two years, starting in 2000.

毎週、コロラド州立大学の、第二外国語(英語ですが)の授業(ESL:English as a Second Language)も受講していました。

Every week, I had taken classes in English as a Second Language (ESL) at Colorado State University.

そのクラスで、「あなたがもっとも面白かった映画を紹介して下さい」という内容のスピーチをする機会がありました。

I had the opportunity to give a speech to that class, that was "Tell us about the movie you enjoyed the most".

クラスの男性たちは、「スターウォーズ」だの「バックツーザフューチャ」などと言っていたところで、私の番が回ってきました。

The men in my class were saying things like "Star Wars" and "Back to the Future", and in my turn, when I said

Let me see... It's "Scent of a woman"

と言ったところで、クラスの女性全員が、一斉に顔を上げて、私の方を見ました。

All the women in the class looked up in unison and looked at me.

「あの映画、凄かったね!」という声でクラスが一気にざわめき、私に対する敬意に満ちた眼差しも感じました。

で、今夜、前回の「シンドラーのリスト」に続き、Amazon Primeでの上映会と相成りました。

So, as the next movie of "Schindler's List, we decided to watch this movie on Amazon Prime.

『この映画だけは日本語吹替は絶対にありえない!』と主張して、私は、字幕版の視聴を独断で決めました。

私も、久々に映画で感動していたのですが、初見の長女は「かっこいい~~!」を連呼しながら、リビングで狂っていました。

以前、日本の人口推定の簡単なシミュレーション結果を、コラムで出したことがあったのですが、これに対して、『コンピュータシミュレーション結果は信じない』というコメントが付いたことがあります。

I once wrote a column about the results of a simple simulation of population estimation in Japan, and I received a comment that said, "I don't believe in computer simulation results".

私は、この人が何を言っているのか分からなかったのですが、数日後に、

I had no idea what this guy was talking about, but a few days later, I noticed that

―― あ、この人は、コンピュータのシミュレーションの結果を『当たる』とか『当たらない』という風に使うものだと思っているんだ

"Oh, she thinks that the results of a computer simulation are used as 'hit' or 'not hit'"

と、気がつきました。

ちなみに、コンピュータでシミュレーションしている人(研究者等)は ―― 『絶対に』と断言してみせますが ―― 自分のそのシミュレーション結果の未来になることを『絶対に』信じていません。

By the way, persons (researchers, etc.) who can computer simulations, never believe that the result of their simulation results are future. I will assure that.

当たり前です。

It's obvious.

未来の未知の不確定要素やその値は、現時点では分からないからです。

This is because the unknown uncertainties of the future and their values are not known at this time.

シミュレーションというのは、例えば「現在と同じ毎日の状態が、これから100日間続いたらどうなるか」というような、仮説を設定しなければ、動かしようがないからです。

100日後の未来の値を入力できるのであれば、そもそもシミュレーションなんぞする必要がありません。

今回のコラムでも述べていますが、これは、誇張でも矮小でもなく、本当の意味で、コンピュータがやっていることは、

です。

ただ、超大量、かつ、超高速であるという点が異なるだけです。

ただ、コンピュータのシミュレーションの結果は、不明な未来に対して、(不確定な未来の事象が存在したとしても)ある程度の範囲で納めることができることは分かっています。

However, we know that the results of computer simulations can be delivered to some extent for an unknown future (even if uncertain future events exist).

全く見えない未来よりは、マシ ―― コンピュータとか、プログラムは、本来そういうものなのです。

It's better than a future you can't see at all.That's what computers and programs are all about.

シミュレーションの結果を「信じる」とか「信じない」とかいう言葉が登場してくる ―― それくらい、私たちの多くは、コンピュータや、プログラムを、理解していないのです。

Words like "believe" and "don't believe" appear in the simulation results. That's how little most of us understand computers and programs.

だって、『電卓を「信じる」とか「信じない」』って言い方する人、いますか?

Because who says 'I believe in calculators' or 'I don't believe in calculators'?

そいういう意味で、私は、義務教育の『プログラミング教育』に期待しています。

In this sense, I have high hopes for compulsory "programming education".

コンピュータは「未来予測マシン」どころか、プログラムのバグ一つで、全く滅茶苦茶な値を出します。

The computer is not a "future prediction machine", but a single bug in the program can produce totally messed up values.

コンピュータは、「魔法の箱」ではありません。

A computer is not a "magic box".

これは、自分でシミュレーションプログラムを書いてみれば、直ぐに分かることです。

You can see this immediately by writing your own simulation program.

Scratch言語で、プログラミングの体験すれば、子どもでも理解できるはずです。

If you experience programming in the Scratch language, even a child should be able to understand it.

ましてや、

―― こんなもの(プログラム)で、人間の知性を越えるようなものが作れるはずがない

"There's no way that something like this (a program) can be made to surpass human intelligence"

ということも。
